These Terms of Carriage govern all freight movements undertaken by Bertram Logistics. By engaging us, you agree to these terms unless a separate signed agreement is in place. Please read them carefully — they set out the responsibilities of both Bertram Logistics and our customers.
1. Quotes and variations. Quotes are valid for 14 days unless otherwise stated and are based on the information you provide. Variations may apply if the load differs from the booking.
2. Payment terms. Payment is due within 14 days of invoice unless otherwise agreed. Overdue accounts may be referred to debt recovery and incur interest at the RBA cash rate plus 4 percent per annum.
3. Liability and insurance. Goods are carried at owner risk unless transit insurance is requested in writing and confirmed before pickup. Our Marine Carriers Liability cover applies subject to its policy terms; we recommend customers maintain their own goods-in-transit insurance for high-value freight.
4. Proof of delivery and claims. Photographic Proof of Delivery is captured on every load. Claims for loss or damage must be lodged in writing within 7 days of delivery, with photographs and supporting documentation. Claims received after 7 days may not be accepted.
5. Dangerous goods. We carry Dangerous Goods (DG) under appropriate accreditation. DG must be declared at time of booking with the correct UN number, class and packing group, and the SDS provided at least 24 hours before pickup. We do not currently provide cold-chain or refrigerated storage.
6. Transit times. Pickup and delivery times are estimates given in good faith. Delays caused by weather, road closures, mechanical breakdown, or third-party warehouse availability are not the carrier's responsibility.
7. Packaging and declaration. The customer warrants that all goods are correctly packaged, labelled and declared. The customer indemnifies Bertram Logistics against any loss arising from incorrect declaration.
8. Compliance and Chain of Responsibility. We comply with the Heavy Vehicle National Law (HVNL), Chain of Responsibility (CoR), and the Road Transport Reform (Dangerous Goods) Act. Customers acknowledge they share CoR obligations as consignors and consignees.
9. Demurrage and waiting time. Demurrage may apply where waiting time at pickup or delivery exceeds 30 minutes. Standard demurrage is charged at our prevailing hourly rate.
10. Cancellations and re-bookings. Bookings cancelled after a vehicle has been dispatched may incur a call-out fee covering time and travel already committed. Where possible, give us as much notice as you can so we can re-plan capacity.
11. Subcontracting. Bertram Logistics may engage approved subcontractors to complete part or all of a movement. Where we do, those carriers operate under our compliance and safety standards, and these Terms of Carriage continue to apply.
12. Undeliverable freight. If freight cannot be delivered because no one is available to receive it, the address is incorrect, or access is restricted, we will attempt to contact you and may return the goods to depot. Redelivery, storage and return charges may apply.
13. Privacy. Information you provide is handled in line with our Privacy Policy and used only to arrange, complete and account for your freight. We do not sell customer information.
14. Governing law. These terms are governed by the laws of New South Wales, Australia. Any dispute will be referred to mediation before any court proceedings.
